Terms of Service (DARK_PROTOCOL)

1. Agreement to Terms

By accessing or using the PULSE. application ("System"), you agree to be bound by these Terms of Service. If you do not agree, you must immediately cease use of the System.

2. Eligibility and Age Restrictions

You must be at least 13 years old to use the System (16 years old in the European Union). By using the System, you represent and warrant that you meet these age requirements. Minors must obtain parental or guardian consent before use.

3. License and IP Rights

We grant you a limited, non-exclusive, non-transferable license to use the System. All intellectual property rights, including the "PULSE." brand, logo, and unique aesthetic designs, remain exclusively with us.

4. Prohibited Conduct

You may not use the System to harass, abuse, or harm others. The use of automated scripts (bots) or attempts to interfere with the System's security is strictly prohibited.

5. Disclaimer of Warranties

THE SYSTEM IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SYSTEM WILL BE UNINTERRUPTED OR ERROR-FREE.

6. Limitation of Liability

EXCEPT IN CASES OF OUR WILLFUL MISCONDUCT OR GROSS NEGLIGENCE, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. THIS INCLUDES LOSS OF DATA OR PERSONAL DISTRESS ARISING FROM SYSTEM USE.

Privacy Policy (PRIVACY_VOID)

1. Data Collection and Purpose

We process minimal identification data (e.g., phone numbers, device IDs) solely for the fulfillment of our contractual obligations to establish communication between users (GDPR Art. 6(1)(b)).

2. Data Deletion (The Void)

PULSE content (Zap signals, badges) is transmitted in real-time and is not stored on our servers once received by the target user. We do not maintain logs of your private communications.

3. Global Privacy Rights

In accordance with GDPR (EU), CCPA (USA), and APPI (Japan), you have the right to request access to, rectification of, or deletion of your personal data. To exercise these rights, please contact our Legal Protocol at m@jagernaut.jpn.org.

4. Cookie Policy

We do not use tracking cookies or third-party marketing pixels within the System or its associated web interfaces.
